6 APPLICATION PROCEDURE
Applications for development plans* for the development of DATA CENTERS must be submitted to the Local Authorities for approval through the current procedures at the One-Stop Centres at Local Authorities (OSCs) as well as the OSC 3.0 Plus system. The following are the application procedure methods for the development of DATA CENTERS in the new area as below:
- Method 1: Application for Planning Permission (KM) Medium Category 3.0 Plus (99 days)
- Method 2: OSC 3.0 plus Industrial Green Lane Initiative Application (IGL) (29 days)
- Method 3: OSC Initiative 3.0 Prerequisite (PR) Application (22 days)
In addition, existing office buildings/ business premises that are suitable for conversion to DATA CENTERS are allowed.
Method 4: Application for Temporary Permit Plan and Minor Construction Permit by the Head of Department (33 days) can be used for development proposals that do not involve amendments to the approval of planning permission and existing building plans.
6.1 Method 1: Application for Planning Permission (KM) Medium Category 3.0 Plus (99 Days)
For the development of DATA CENTERS using Method 1, it is based on the application for permission to design the Medium Category in the OSC Manual 3.0 Plus (First Edition, 2019). It is necessary to comply with several criteria as follows:
- Development of DATA CENTERS that are in line with the real conditions of the land;
- Development of DATA CENTERS involving one/more new development phases in a development scheme for which the layout plan (KM) has been approved;
- Development of DATA CENTERS involving main switching stations involving a voltage of 33kV @11kV with a maximum power capacity of 25 MVA (single customer/ public distribution license);
- Involving simultaneous applications with any combination of applications for medium category planning permits, road and drainage plans, earthworks plans and building plans.

6.2 Method 2 : OSC 3.0 Plus Initiative Application Industrial Green Lane (IGL) (29 Day)
The Industrial Green Lane (IGL) initiative is one of the efforts to improve the OSC 3.0 PLUS System, especially the planning permission process and procedures for planned industrial estates. Therefore, the development of DATA CENTERS in industrial land use planning zones is encouraged using Method 2.
Before submitting an application formally in the OSC System
3.0 Plus Online, the developer / Principle Submitting Person (PSP) / Submitting Person (SP) must obtain the consent between the Mayor/ YDP and the developer first.
For the initial technical coordination through the Technical Briefing of the Project (TBP) session, the application is submitted to the Industrial Green Lane (IGL) Unit in a Local Authority for preliminary review within 14 days as well as the determination of the acceptance of the IGL project. The TBL session must be held physically and chaired by the Mayor/ YDP together with all stakeholders (developers, PSP/SP, internal technical agencies of local authorities and relevant external technical agencies)
There are several criteria that need to be met for a proposed development of DATA CENTERS to be processed under the IGL initiative.
These include:
- Proposed development only in planned industrial areas where the proposed development area has been approved for the Planning Permission (KM) layout (Master Plan);
- Land matters/matters (payment of Notice 5A [KTN] premium has been completed;
- Availability of a site for the erection of the building;
- Availability of connection of external utility supplies (electricity, water, communications, sewerage, gas and others);
- The proposed development has obtained the approval of the EIA Report, TIA and RSA; and
- The proposed development is not intended to be rented out to parties other than the owner.
PSP/SP must comply with the initial technical review decided during the TBP before submitting an official application through the OSC 3.0 Plus Online System.
In the IGL Initiative, the concept of agile regulation is applied to ensure rapid implementation from the planning stage until the building is completed and operational, this includes:
- IGL’s initiative to shorten the approval period for planning permission from 99 days to 29 days;
- The developer will obtain prior approval for the erection work of the building once the planning permission is approved. This includes site cleaning, hoarding installation, workers’ houses, project signage, piling work, site foundations and building construction; and
- Developers can submit a business license application once the construction has achieved 80% progress on the site and is approved within 24 hours after the Certificate of Completion and Compliance (CCC) is issued.

6.3 Method 3 : OSC 3.0 Plus Prerequisite (PR) Initiative Application (22 Days)
Prerequisite is a proposal for improvement to the existing pre-consultation process and procedure that prioritizes the concept of Easy-Self Regulated System. PR is feasible for all types of developments including DATA CENTERS. The implementation of PR process improvements will be carried out through the development of new modules in the OSC 3.0 Plus Online System.
PSPs need to apply online through the OSC 3.0 Online Plus system. Next, the local authority will conduct an online check and inform the PSP of the payment of the prescribed fee. Once the PSP has made the payment, the PBT will distribute the application online to the technical agency to make a comment. PSP will complete the application based on the compliance instructions as well as obtain a pre-condition notification letter from the technical agency. The local authority raised the application to the OSC Committee Meeting and distributed the results. PSP must first clear the payment of the development fee to obtain an official approval letter.
There are several criteria that need to be met for a DATA CENTERS development proposal to be processed under the PR initiative. These include:
- Land matters/matters have been completed before the implementation of PR; and
- Development plan applications must be submitted simultaneously (KM, road and drain plans, earthworks plan and building plans) through the OSC 3.0 Plus Online System after the completion of PR matters.

6.4 Method 4: Application for Temporary Permit Plan and Small Construction Permit (33 days)
For the development of DATA CENTERS in an existing building that does not involve amendments to the approval of planning permission and the original building plan, it can submit an application using Method 4.
There are several criteria that need to be met for a DATA CENTERS development proposal to be processed under Method 4. These include:
- Existing buildings have obtained CCC;
- Existing buildings must have a Lapidated Report to ensure that there is no disturbance to adjacent buildings;
- The building is not adjacent to the residential premises;
- The building is in a commercial or industrial land use; and
- Comments and approvals on the electricity and water supply requirements have been obtained in advance from TNB and the State Water Supply Company.
